In as much as the Bank would have wished to deduct these charges from source, we regret to inform you that this is not practicable. The Bank has set standard and established rules and regulations upon which it operates. This is also applicable to every other financial institution elsewhere and internationally.

The instruction to pay and remit a specified sum emanated from the managements of Economic Community of West African States (ECOWAS and we observed that you are not a signatory to this account but only the beneficiary/recipient. We so not have the powers to change this figure in order to satisfy our clients. It is punishable by law.

Moreover, bank charges, cost of transfers and ether administrative charges cannot be withdrawn from "noted" accounts except the beneficiary is also the drawer and must have given a written instruction. This stated sum has been endorsed, approved and vanchered by the Board of Directors of our Bank in recongnition of its magnitude, and same sum computerised and entered into data by all concerned local and foreign departments.

You are, however given the grace to comply on or before 3rd February 2001 for status upgrading and confirmation. This transaction will be cancelled if this payment is not made. Contact the undersigned and enquire on how you could make the remittance immediately.

Bien que la Banque aurait voulu déduire ces charges de la source, nous regrettons de vous informer que ce n'est pas praticable. La Banque a mis la norme et a établi des règles et des règlements sur lesquels elle fonctionne. C'est aussi applicable à chaque autre établissement financier ailleurs et internationalement.

L'instruction pour payer et virer(renvoyer) une somme indiquée a émané des gestions de Communauté Économique des États de l'Afrique occidentale (ECOWAS et nous avons observé que vous n'êtes pas un signataire à ce compte, mais seulement le bénéficiaire / destinataire. Ainsi, nous n'avons pas les pouvoirs pour changer ce chiffre pour satisfaire nos clients. C'est punissable conformément à la loi.

But I have to be very frank with you Mr. Fortier, that how can we be doing business with you and now that the bank has asked for a little charge to enable this transaction be concluded,you are telling me now that you cannot afford the money.

De plus, cette affaire est assez inusitée et je n'ai pas tous les renseignements pour bien comprendre ce qu'il en ait; du point de vu de l'impôt local et canadien par exemple; ni du type d'activité et de fourniture faits par la société JACQUES FORTIER S.A.R.L. Je ne sais même pas ce que "SARL" signifie!

Aussi, je me dois d'être prudent afin de ne pas mettre mon équilibre financier en péril. Je me demande même si la "Chase Manhattan Bank" ne va-t-elle pas, elle aussi, demandé le paiement d'autres frais, et de combien?

Je peux envoyer la moitié de la somme demandée à la Société Générale de Banque au Togo, soit 3763 US$. Je pense pouvoir faire cela durant la journée de mardi. Mais je dois avoir l'assurance auparavant que vous puissiez payer l'autre moitié.

Et alors, j'aviserai la Société Générale de Banque au Togo du paiement par transfert de fonds de cette moitié et leur indiquerai que vous leur paierez l'autre moitié sur place. Cependant, ils devront m'indiquer à quel compte faire ce transfert.

Furthermore, this affair is rather uncommon and I have not all the information well to understand what it has it; of the point of seen with the local and Canadian tax for example; nor the type of activity and supply facts by the JACQUES FORTIER S.A.R.L company(society). I do not even know what "S.A.R.L" means!

So, I owe be careful not to put my financial balance in danger. I wonder even though does not " Chase Manhattan Bank " go, it also, asked the payment of the other expenses, and of how much?

I can send half of the sum asked the Société Générale de Banque au Togo, or 3763 US$. I think of being able to make it during the day of Tuesday. But I have to have assurance previously that you can pay the other half.

Thank you for your reply letter. At least, you are now making move and talking something very reasonable. How did you think you could allow this golden opportunity to slip us by. You know, it would have been a very big joke and this would have caused our dismissal.

Any how, I am sorry that you were not initially informed by the partners. But we never expected that there would be any other expenses to be incurred after we had expended and put every document in order. I am truely sorry for this but as a businessman, instead of your multimillion dollar business to damage because of a peanut, you better place some collaterals and secure the business. You have to assist us now that the bank so urgently needs this charge to credit this money.

I have spoken to the other partners and they have contributed the balance of the money that you will pay to the bank. As soon as you inform us that you have paid the bank the part you have, we shall through a Lawyer, pay the balance and send the receipt to you. So please, make sure you pay this money on or before Tuesday, as you indicated. Inform us immediately as soon as you paid so that the Lawyer can go and pay the balance.

The meaning of "S.A.R.L" is a technical term in the formation of companies here. It means "LIMITED LIABILITY" It is only very viable and big companies that have this tag.

We do not think that Chase Manhattan will demand any other charge because their duty is to pay your bank.

Do not worry about the tax issue of your country. As soon as the money is credited, we shall send to you documents to prove and support so that the tax will not be much. Your only concern now is to make sure that this money goes into your account.

Nous ne pensons pas que la Chase Manhattan exigera une autre charge parce que leur devoir est de payer à votre banque.
